Service Terms & Conditions
Weather does play an important role in our ability to service your property properly and we would appreciate your patience in providing us grace time to attend to the service schedule. In consideration for the services provided by Hodder Landscaping, you agree to adhere to the following terms and conditions:
Description of Services
- Spring Clean Ups (April 1 – May 31, weather dependent): The services provided during a spring cleanup visit include cleaning the lawn and bed areas of any debris in preparation for the season, sweeping gravel and sand from the winter season and repairing any plow damage. Spring cleanups are booked on a first come first serve basis.
- Lawn maintenance (May 1 – November 15): Our mowing service is done on a weekly basis. Mowing may move to bi-weekly cuts during August, depending on weather and grass growth rate. Lawns are maintained between 3.5 and 4 inches, unless otherwise discussed.
- Additions to the standard services include the following:
- Late contracts (with overgrown lawns) will have the first cut & trim billed hourly to account for grass length and disposal. All subsequent cuts will be billed at the contract rate.
- Once your mowing is scheduled, you will have a set day. Dog waste shall be removed from the lawn area before service. If not, there may be a fee charged or that area not serviced, depending on amount. This will still result in a full charge. Debris, objects or decor (such as solar lights, patio sets etc) left in the lawn area are the responsibility of the customer. We will do our best to trim around objects, but will not be held accountable for any damages. Please have these types of objects moved prior to your scheduled mow day.
- Landscape Maintenance (April 15 to November 30, weather permitting) - These services run throughout the season and are performed as scheduled or as requested.
- Fall Clean Ups (October 15 – November 30, weather dependent) – Services are provided during 2 to 3 visits, based on the duration of the leaf season. Fall cleanups are booked on a first come first serve basis and weather permitting.
Performance of Services
- Services that are delayed due to weather will be rescheduled for the next weather-permitting day or shortly thereafter, depending upon the number of continuous days affected by the weather.
Fees
- Estimated fees are based on the assessment of the property performed by Hodder Landscaping and the jobs requested. Any change to the property or additionally requested work during a visit, Hodder Landscaping holds the right to adjust the price or apply additional charges on the following invoice.
- Estimates are valid for 15 days from the date given. Currently, during COVID and with the uncertainty of the global economy, if services are being booked in advanced of more then 15 days out, Hodder Landscaping holds the right to adjust approved quotes based on material cost. The client will be notified of such change before any of the services are performed.
- Fuel Surcharge: Due to the constant fluctuations in fuel prices, a fuel surcharge will be activated when fuel reaches 1.70$/L. The fuel charge will be applied to the monthly invoice in a flat rate of 20$.
Payment
- We accept Etransfer, Cheque, and debit/credit card in person at the office or online.
- Credit card payments are subject to a 2.5% convenience fee
- Payment is due within 15 days of receiving the invoice, unless otherwise discussed. Credit cards on file will be charged the first week of the following month and an emailed receipt will be sent.
- If payment of an invoice is not made within the given terms , Hodder Landscaping may charge the Client interest on the unpaid amount at 2% compounded monthly, until paid. An additional administration fee may also apply to any late payment and all declined cheques or credit cards.
- Invoices will be deemed as correct and non-negotiable after 48 hours from invoicing date.
Payment plans
- Hodder Landscaping offers 3 types of payment plans for our customers. Our standard option is pay as you go, and this is billed at the end of each month. The second option is monthly payments over 6 or 12 months. Multiple services need to be selected for this option. The third type of payment plan is pre-pay, where all services are paid prior to the start of the season, in which qualifying clients will receive a 10% discount.
Limit of Liability
- Hodder Landscaping’s obligations under this contract are limited to providing or causing to be provided the services and Hodder Landscaping does not assume any other liabilities or obligations of or to the client under this contract.
- The Client shall indemnify, fully protect, save harmless and defend Hodder Landscaping and all persons providing the Services under this contract against and from losses, costs and damages arising as a consequence of actions, proceedings, claims or demands brought or made by or against Hodder Landscaping, the Client, or their affiliates, employees, agents or contractors or by any other persons as a result of the provision of the Services under this contract.
Cancellation:
- Suspension, termination or interruption of the Services provided requires a minimum of 7 days advanced, written notice. Such notice includes email, text or mail.
- Any of the Services performed or scheduled to be performed prior to the 7 days advanced written notice period will be included on Client’s next invoice and due immediately upon receipt.
Renewal:
- Our lawn and landscape maintenance service agreement automatically renew from year to year. The client will be signed up for the same services and payment plan as the previous year. There will be a 2% increase on the 1st of April every year, to match inflation
- With the initial acceptance of the quote, the client in turn agrees to the terms of our service agreement, which can be found online or by request
